Terms of Service

By accessing or using HexArena (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and the HexArena operator (“we,” “us,” or “Operator”).

HexArena is an online skill-based strategy game implementing a hex-board variant of Othello. The Service offers two gameplay modes:

• Casual — practice mode, free to play. A bot opponent is available when no human opponent joins within a reasonable time.
• Arena — matches with optional USDT stakes. Stakes are processed through the ArenaSettlement smart contract on the Celo network.

HexArena is provided as-is. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use Arena mode. Casual mode may be used by players of any age, subject to local law.

The Service is not available in jurisdictions where participation in games with monetary stakes is prohibited by law. It is your responsibility to ensure that your use of the Service is lawful in your location.

HexArena does not create user accounts. Your MiniPay wallet address serves as your unique identifier within the Service. You are solely responsible for maintaining the security of your wallet and for any activity that occurs through it.

You must not share your wallet credentials or allow others to access your wallet. The Operator does not have the ability to restore or reset your wallet access.

Deposits transfer USDT from your MiniPay wallet into your HexArena Game Balance via the ArenaSettlement smart contract on Celo Mainnet. Withdrawals transfer USDT from your Game Balance back to your MiniPay wallet the same way.

The Operator absorbs the Celo network token transfer fee (approximately 1.5%) for deposits so that your Game Balance reflects the full deposited amount. For withdrawals, the Operator also absorbs this fee.

Withdrawals are processed by the Operator signing the on-chain transaction with a dedicated operator key. Your wallet never signs withdrawal transactions directly.

The minimum deposit and minimum withdrawal amounts are $0.10 USD. The Operator reserves the right to adjust these minimums with reasonable notice.

All game moves are validated server-side by the HexArena game server. The server is the authoritative source for game state. HexArena employs measures to detect and prevent unauthorized access, cheating, and manipulation of game outcomes.

Each player has 45 seconds to make a move. Failure to move within this window results in automatic forfeiture of the match. The shared match clock runs continuously and does not pause between turns.

The Operator may void a match or withhold payouts if there is reasonable evidence of cheating, exploitation of a bug, or violation of these Terms.

From time to time, the Operator may offer tournaments or leaderboards with prizes. Eligibility, rules, and prize distributions for such events will be published separately and will form part of these Terms when published.

Arena mode applies a 20% rake to the stake of each match. For example, on a $1.00 stake, $0.20 goes to the Operator and the remaining $0.80 is distributed to the winner. In the case of a draw, the stake is returned net of the rake to each player.

Network fees for on-chain transactions are absorbed by the Operator and are not deducted from your balance.

You agree not to:

• Use automated scripts, bots, or any external software to interact with the Service
• Exploit bugs, glitches, or design errors for advantage
• Create multiple accounts to circumvent restrictions or manipulate leaderboards
• Engage in money laundering, fraud, or any other financial crime using the Service
• Harass, threaten, or incite harm against other players or the Operator's staff
• Attempt to interfere with, compromise, or disrupt the game server or smart contract
• Use the Service in any way that violates applicable law

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Operator does not warrant that the Service will be uninterrupted, secure, or error-free. The Operator is not responsible for any losses arising from network disruptions, blockchain confirmation failures, or circumstances beyond its reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER THE OPERATOR WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE OPERATOR'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF USDT DEPOSITED BY YOU INTO THE GAME BALANCE IN THE THIRTY (30) DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless the Operator and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service.

These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may pursue binding arbitration in accordance with the rules of the Cayman Islands Grand Court.

For time-sensitive matters, the Operator may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

The Operator reserves the right to modify these Terms at any time. Material modifications will be communicated by posting updated Terms at /legal/terms and, where practicable, through the Service itself. Your continued use of the Service after any modification constitutes acceptance of the updated Terms.
